"In accordance with General Condition 20 of the Fixed Telecommunication Network Services (FTNS) Licence, Cable & Wireless HKT Telephone Limited, Cable & Wireless HKT International Limited, Cable & Wireless HKT CAS Limited (collectively "the Company") hereby publishes the tariffs, the terms and conditions under which it will provide the following telecommunication services with effect from 1st February 2000.

Condition to qualify for country discount:
a) Each qualified country total bandwidth must not be less than 1Mbps.
b) Total bandwidth must not be less than 20Mbps.

 

ADDITIONAL INCENTIVES
1. Satellite Discount - an additional 15% discount will be applied to circuits with satellite as transmission media.
2. Progression Discount - an additional 10% discount will be applied in the consecutive year on every completion of twelve month lease period. The maximum number of yearly count of each circuit is three, and the lease period is required on a continuous basis.
3. Project Discount - the corresponding discount percentage (e.Circuit or e.Bandwidth) in respect to the committed project size of its network will be applied as soon as the first circuit is provisioned.
4. Term Discount - in the event that the Customer wishes to enter into a Minimum Commitment Period longer than one year, an additional 10% discount per year will be applied with a maximum of 40%. The Term Discount and Progression Discount are mutually exclusive.
5. Upgrade Discount - an additional 10% discount will be applied on circuit upgraded from 56Kbps and above provided that the circuit has a minimum in-service period of three months.
6. Hubbing Expansion Incentive - an additional discount of up to 25% will be offered to Customers for establishing or expanding their regional telecommunications hub in Hong Kong.

CANCELLATION CHARGE
In the event that the Customer cancels the Service before the expiry of the Minimum Commitment Period, the Customer shall be liable for payment of the cancellation charges as follows:

MCP of 1 year 25% of the IPLC Monthly Basic Rental payable for remaining unexpired term
MCP of 2 years and above 15% of the IPLC Monthly Basic Rental payable for remaining unexpired term

 

 

 

 

 

 

 

 

 

 

 

 

 

APPENDIX IPLC_Px.I.G.3

HUBBING EXPANSION INCENTIVE SCHEME UNDER PLATINUM PLAN

The Hubbing Expansion Incentive Scheme applies to full time International Private Leased Circuits (IPLC) at speed 56Kbps and above, and will only be offered to the Customer for establishing or expanding their regional telecommunications hub in Hong Kong.

The Incentive Scheme will be in a form of discount percentage calculated based on the following formula:

All above variables are measured on the Customer's entire IPLC DDS network at circuit speed 56Kbps and above.



Hubbing Expansion Incentive Scheme Criteria:

To quality for the Incentive Scheme, all of the following criteria may have to be fulfilled to the Company's satisfaction:

  1. The Customer must use Hong Kong as the main regional telecommunications hub.
  2. The Customer must commit to the Company on its IPLC DDS expansion requirement in terms of bandwidth volume, number of circuit and number of destination countries.
  3. The total current bandwidth usage of the Customer's entire IPLC DDS network must not be less than 256Kbps.
  4. The total current number of circuits employed by the Customer must not be less than 3.
  5. The total current number of destination countries of the Customer's hubbing network must not be less than 3.


Notes:

(a) The Incentive Scheme applies to full time DDS circuits at speed 56Kbps and above.
(b) The Incentive Scheme will apply in addition to the IPLC DDS Discount Plans on a discount-on-discount basis i.e. Monthly Basic Rental x {1 - Discount A} x {1 - Discount B}…. = Net Discounted Amount.
(c) The committed network expansion in terms of bandwidth, circuits and destination countries has to be implemented within the committed network hubbing expansion period which is 6 months unless agreed otherwise between the Company and the Customer.


Cancellation Charge:
In the event that the Customer fails to meet the committed expansion of its network by the end of the committed network hubbing expansion period or cancels the Incentive Scheme during the committed network hubbing expansion period, the Customer shall be liable to a cancellation charge based on the following formula:

Scheme Billed Amount x Incentive Percentage / (1 - Incentive Percentage)

where, Scheme Billed Amount refers to the total billed charges for all IPLCs subject to the Incentive Scheme during the committed network expansion period in which the Incentive Scheme has been applied.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

APPENDIX IPLC_Px.I.G.4

GUIDANCE NOTES FOR PLATINUM DISCOUNT PLAN


1. General Rules

All full time use of the Digital Data Service (DDS) circuits at speed 56Kbps and above will qualify for the DDS Discount Plan.

The customer can choose and apply one DDS Discount Plan for his IPLC DDS network with circuit speed at 56Kbps and above. Customer can have the option to switch from one DDS Discount Plan to another DDS Discount Plan provided that the Minimum Commitment Period is unchanged as a result of the plan change. Provided that the Minimum Commitment Period has not changed the Company may waive the Cancellation Charges in relation to the plan change. The cut over date to other DDS Discount Plan will be on the 1st day of the following month.

All DDS Discount Plans' incentives will be applied to the Monthly Basic Rentals. The calculation of discounts is on discount-on-discount basis i.e. Monthly Basic Rental x { 1 - Discount A } x { 1 - Discount B } …. = Net Discounted Amount.

Unless otherwise agreed between the Company and the Customer, the Minimum Commitment Period of full time DDS circuits at speed 56Kbps and above is 3 months.


2. Platinum Discount Plan

2.1 This discount plan applies to full time DDS circuits at speeds 56Kbps and above. All
circuits which will be subject to this discount plan must have at least one year Minimum Commitment Period with the Company in order to qualify for the Platinum Discount Plan.

2.2 There are two hubbing discount options under this Platinum Discount Plan, namely:

e.Circuit Discount Option (consists of Circuit Discount + Country Discount); and
e.Bandwidth Discount Option (consists of Megabits Discount + Country Discount).

N.B. These hubbing discount options are not applicable to sub-rate DDS circuits at
speed below 56Kbps.

2.3 In calculating the number of circuits under the e.Circuit Discount Option, circuit speeds at and below E1 will be counted as one circuit and circuit speeds above E1 will be counted in steps of E1 bearers, e.g. one T3 circuit equals 21 E1 circuits.

2.4 In calculating qualification for the Country Discount's incentives under the e.Circuit
Discount Option, countries with aggregated bandwidth less than 128Kbps will not be included in the calculation of the number of countries.

2.5 In calculating qualification for the Country Discount's incentives under the e.Bandwidth
Discount Option, the Customer must subscribe to CWHKTI for aggregate bandwidth usage not less than 20Mbps for the Customer's IPLC DDS network with circuit speeds at 56Kbps and above included in the e.Bandwidth Discount calculation, and in calculating the number of countries, those countries with aggregate bandwidth of less than 1Mbps will not be included.

3. Additional Incentives

3.1 Satellite Discount

3.1.1 This discount applies to full time IPLCs via satellite transmission media at speeds of 56Kbps and above.

3.2 Progression Discount

3.2.1 The Progression Discount applies to full time IPLCs at speeds of 56Kbps and above.

3.2.2 All circuits eligible for the Progression Discount must have completed at least one year Minimum Commitment Period with the Company, from when the Customer subscribed to this Platinum Discount plan, in order to qualify for the Progression Discount.

3.3 Project Discount

3.3.1 The Project Discount applies to full time IPLCs at speeds of 56Kbps and above,
and will only be offered to the Customer who has committed to, and placed firm orders for, a bundle of circuits ("Project Commitment Size") to be established by phases within six months of the order placement or some other period as agreed between the Company and the Customer.

3.3.2 The corresponding discount level (e.Circuit Discount Option or e.Bandwidth
Discount Option) in respect of the Project Commitment Size of the Customer's network will be applied as soon as the first circuit has been provisioned and is in service.

3.3.3 In the event that the Customer fails to meet the Project Commitment Size by the end of six months or some other period as agreed between the Company and the Customer, the Customer shall be liable to a cancellation charge based on the following formula:

Where : Billed Amount is the total amount billed by the end of six months or some other period as agreed between the company and the Customer.

Granted Discount Percentage is based on the Project Commitment Size.

Achievable Discount Percentage is based on the actual network project size by the end of six months or some other period as agreed between the Company and the Customer.

3.3.4 The offer of a Project Discount will be subject to the availability of capacity.

3.4 Term Discount

3.4.1 In the event that the Customer wishes, at the commencement of the Customer's subscription to the Platinum Discount Plan, to enter into a Minimum Commitment Period longer than one year, an additional 10% discount per year will be applied up to a maximum additional discount of 40%. The Term Discount and the Progression Discount are mutually exclusive.

3.4.2 In the event that the Customer cancels the Service before the expiry of the
Minimum Commitment Period, the Customer shall be liable for payment of the cancellation charges as follows:

MCP of 1 year 25% of the IPLC Monthly Basic Rental payable for remaining unexpired term
MCP of 2 years and above 15% of the IPLC Monthly Basic Rental payable for remaining unexpired term

3.5 Upgrade Discount

3.5.1 The Upgrade Discount applies to full time IPLCs at speeds of 56Kbps and
above.

3.5.2 To qualify for the Upgrade Discount, each circuit subject to the Upgrade Discount must have been in service for at least three months.

3.6 Hubbing Expansion Incentive Scheme

3.6.1 The Hubbing Expansion Incentive Scheme applies to full time IPLCs at speeds of 56Kbps and above, and will only be offered to Customers for establishing or expanding their regional telecommunications hub in Hong Kong.


N.B. For scheme detail, refer to Appendix IPLC_Px.I.G3.

4. Up Front Payment

In the event that the Customer wishes to pay up front, a discount factor will be applied as agreed between the Company and the Customer.


5. Conditions of Service

This discount plan is made available by the Company to the Customer subject to the Company's General Conditions of Service and the Special Conditions of International Private Leased Circuit Service.
